By using www.moodifypet.shop or buying MoodifyPet products, you agree to these terms. Please read them carefully. Sections 10 and 11 contain a binding arbitration agreement and a class-action waiver that affect your legal rights.

1. Use of the Site

You agree to use this website only for lawful purposes and in a way that does not infringe the rights of others. You may not attempt to gain unauthorized access to any part of the site, our servers, or any connected database. You represent that you are at least 18 years old (or the age of majority in your jurisdiction).

2. Products & Pricing

We do our best to display product details, images, and prices accurately, but errors can occur. We reserve the right to correct any errors and to refuse or cancel orders placed with incorrect pricing — even after the order is confirmed — in which case we will refund the amount charged in full. All prices are listed in U.S. dollars and exclude any applicable taxes unless stated otherwise.

3. Orders & Payment

Placing an order is an offer to buy. We accept your order when payment is captured and a confirmation email is sent. Payment is processed by Shopify Payments and other certified providers; we do not store your card details.

4. Shipping, Returns & Refunds

Shipping and returns are governed by our <a href="/pages/shipping-returns">Shipping & Returns Policy</a>, which forms part of these terms.

5. Subscription — Get Fresh Home Plan (Recurring Billing)

The MoodifyPet Get Fresh Home Plan is an auto-refill subscription. When you enroll:

• Recurring charges. You authorize us to charge your payment method the subscription price shown at checkout every 30 days, plus any applicable taxes and shipping, until you cancel. The subscription has no fixed end date.
• Cancel any time. You may cancel in the same medium you signed up (online) at <a href="/pages/cancel-subscription">moodifypet.shop/pages/cancel-subscription</a> or by emailing <a href="mailto:info@moodifypetus.com?subject=Cancel%20my%20subscription">info@moodifypetus.com</a>. Cancellation stops all future charges immediately. No retention call or "save offer" is required.
• Renewal reminders. If your plan includes an introductory discount or free/gift period longer than 31 days, we will remind you by email 3–21 days before the regular price begins. For any plan with a term of one year or longer, we will send a renewal reminder 15–45 days before renewal.
• Full terms. The complete billing, cancellation and refund terms are in the <a href="/pages/subscription-terms">Subscription Terms</a>, which are incorporated into these Terms of Service.

6. Intellectual Property

All content on this site — including the MoodifyPet name, logo, product names, photography, copy, and design — is owned by or licensed to MoodifyPet and protected by intellectual-property law. You may not reproduce or use it commercially without written permission.

7. Disclaimer & Limitation of Liability

MoodifyPet is a fragrance-free during use passive odor-neutralization product. It is not a medical, veterinary, or air-purification device. Results vary with room size, ventilation, litter type, and number of cats. To the fullest extent permitted by law, MoodifyPet disclaims all implied warranties, including the implied warranties of merchantability and fitness for a particular purpose, and is not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the site or product. Our total aggregate liability for any claim relating to a product will not exceed the amount you paid for that product. Some jurisdictions do not allow the exclusion or limitation of certain damages, in which case these limits apply to the maximum extent permitted.

8. Electronic Communications

By providing your email you consent to receive electronic communications from MoodifyPet, including order confirmations, shipping updates, subscription renewal reminders, and legally required notices. You may opt out of marketing emails at any time using the unsubscribe link in any marketing message; transactional and legally required messages will continue.

9. Privacy

Our <a href="/pages/privacy">Privacy Policy</a> (including the <a href="/pages/do-not-sell">Do Not Sell or Share My Personal Information</a> page for California residents) is part of these terms.

10. Binding Arbitration — Please Read Carefully

You and MoodifyPet agree that any dispute, claim or controversy arising out of or relating to these terms, your use of the site, or any product you purchase from us shall be resolved exclusively by final and binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, rather than in court, except that either party may bring an individual action in small claims court and either party may seek injunctive or equitable relief in court to protect its intellectual-property rights.

The arbitration will be conducted in English, seated in the county of your residence within the United States (or, if outside the U.S., in New Castle County, Delaware). Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this Section.

30-day right to opt out of arbitration. You may reject this arbitration agreement by emailing info@moodifypetus.com, your full name, your postal address, and the email associated with any account or order, within 30 days of first accepting these terms. Opting out will not affect any other part of these terms.

11. Class-Action Waiver

You and MoodifyPet agree that each may bring claims against the other only in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding. If a court decides that applicable law precludes enforcement of this waiver as to a particular claim, that claim (and only that claim) shall be severed and brought in a court of competent jurisdiction; the arbitration agreement and this waiver remain enforceable as to all other claims.

12. Governing Law & Venue

These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules, except that the Federal Arbitration Act governs Sections 10 and 11. Subject to the arbitration agreement, the state and federal courts located in New Castle County, Delaware have exclusive jurisdiction over any dispute not subject to arbitration, and the parties consent to personal jurisdiction and venue there.

13. Changes to These Terms

We may update these terms from time to time. The latest version will always be posted on this page with an updated date. Material changes will be communicated by email to active subscribers at least 30 days before they take effect.
